Terms and Conditions

1. Definitions

Working days – days from Monday to Friday, excluding public holidays.

Client – a natural person, any entity, legal person or organisational unit without legal personality which, having the capacity to perform legal acts, uses the Shop to make purchases and carry out other activities.

Consumer – a natural person making purchases for purposes not directly related to their business or professional activity / in accordance with Article 22(1) of the Act of 23 April 1964 – the Civil Code /

Account – an individual, free-of-charge account set up by the Buyer in the Shop for the purpose of carrying out electronic transactions – governed by separate terms and conditions

Shopping basket – a Shop feature enabling the entry, modification and display of all data relating to a product order, namely: the selected product, the number of products, the delivery address, the delivery method and the payment method.

Payment processor – an external entity acting as an intermediary in the processing of payments by bank transfer or card payment

2. General provision

  1. These Terms and Conditions set out the rules governing:
    1. registration with the Shop
    2. use of the Shop
    3. placing orders for products offered by the Shop, their delivery and payment for them
    4. the right of Customers to cancel an order and withdraw from the contract
    5. submitting and handling complaints
  2. To browse the Store’s web pages and the products available therein, you will need a device with internet access and a web browser that supports JavaScript and cookies, such as Internet Explorer, Google Chrome, Microsoft Edge, Mozilla Firefox, Opera or Safari.
  3. To use the Shop’s functions relating to registration and placing orders for products, an active email account is required.
  4. Browsing the Shop’s product range does not require registration.
  5. To place orders for products available in the Shop’s range and make purchases, the Customer must choose one of the following options:
    1. registering an Account in accordance with the provisions of § 3 of these Terms and Conditions, or
    2. providing personal and address details enabling the order to be fulfilled
    3. without registering
  6. Transactions made by payment card and e-transfer are processed via the Przelewy24.pl service
  7. The shop, its website and all content published on its web pages or on any forums or media – in particular informational or advertising content – as well as the form in which such content is presented, are subject to the exclusive rights of Playade sp. z o.o. or third parties and are protected by law. Furthermore, this content and these forms have been customised in a way that identifies Playade. Consequently, copying or any other processing or use of this content or these forms, or of content or forms resembling them, may result in legal liability, in particular under the provisions of the Civil Code on the protection of personal rights, the provisions of the Act of 4 February 1994 on copyright and related rights (Journal of Laws 2006.90.631, consolidated text, as amended) or the provisions of the Act of 16 April 1993 on Combating Unfair Competition (Journal of Laws 2003.153.1503, consolidated text, as amended). Customers are prohibited from uploading to the Shop’s website any content that infringes the law, offends public decency or infringes the rights of third parties; from taking any action that interferes with the functioning of the Shop, its content or technical elements; from sending spam; or from conducting any business activity on the Shop’s website. All product names featured on the Shop’s website may be protected and registered under the provisions of the Act of 30 June 2000 – Industrial Property Law or other legal provisions.
  8. The Account Agreement and the agreements for the sale of products are concluded in Polish and are governed by these Terms and Conditions. Prices are quoted in Polish.
  9. The Shop may amend the Account Terms and Conditions only in justified cases, in particular in respect of changes to technical conditions, the ordering and contract conclusion process, contact details, identification numbers, addresses, improvements to the quality, functionality and security of the service provided, as well as changes to the legal provisions governing the Shop’s operations. Such changes will be announced on the Shop’s website and communicated to each Customer 14 days in advance in writing to the specified email address. If the Customer does not accept the amendments, they may terminate the Account agreement by sending the relevant notice to the Shop’s email address; in all other cases, the amended Terms and Conditions shall be deemed binding on the Customer. The amended Terms and Conditions shall not affect orders placed prior to their introduction.
  10. None of the provisions of these Terms and Conditions excludes or limits the Consumer’s rights under the law.

3. Registration

  1. Registration with the Shop and the creation of an Account are entirely voluntary and at the Customer’s discretion. This enables the Customer to set up a personal, free Account, through which the Customer can make use of the following features:
    1. entering, editing, modifying and deleting data
    2. entering different delivery addresses
    3. placing orders using the data they have entered
    4. viewing their order history
    5. using discount codes where these are made available by the Shop
    6. making payments for orders placed using the payment method of your choice
    7. using other features available to Customers with an Account
    8. ordering goods
  2. In order to register and set up a personal Account, the Customer must complete and submit the online registration form, providing their full name or nickname (username), email address and password, as well as read and accept the provisions of these Terms and Conditions.
  3. Once the Customer has completed and submitted the registration form, the Shop will send a confirmation of registration to the email address provided by the Customer, which signifies the conclusion of a contract between the Customer and the Shop for the provision, free of charge, of an electronic service consisting of the maintenance of the Customer’s account in accordance with the terms set out in these Terms and Conditions.
  4. Once the Account has been registered with the Shop, the Customer uses the Account and the details entered therein to communicate with the Shop and to fulfil the orders they place; they may do so after logging in using the details provided during Account registration or any subsequent modifications thereto.
  5. The Account created by the Customer is maintained by the Shop free of charge and for an indefinite period.
  6. The Customer may, at any time and without incurring any charges, cancel their Account with the Shop and request its deletion by submitting a written request to the Website’s email address. The Account will be deleted immediately following confirmation of the Customer’s details, and this shall be deemed to constitute termination of the agreement with the Shop regarding the maintenance of the Customer’s Account.
  7. The Shop is entitled to delete a Customer’s account in the event of a breach of the law, the rights of third parties, the principles of social coexistence, a breach of these Terms and Conditions, the provision of incorrect details preventing the fulfilment of an order, or the repeated placing and cancellation of orders – by sending a statement to the email address specified in the registration form, which is tantamount to terminating the agreement with the Shop regarding the maintenance of the Customer’s account.
  8. The deletion of a Customer’s account in accordance with paragraph 7 or paragraph 8 results in the cancellation of any orders placed by the Customer and the refund of any amounts paid.

4. Product information

  1. Information about products available in the Shop constitutes an offer within the meaning of Article 71 of the Civil Code. 2. Product prices in the Shop include VAT and are quoted in Polish zlotys; they do not include delivery costs.
  2. Delivery costs depend on the value and size of the order, as well as the delivery method chosen by the Customer, and are added to the price of the products ordered.
  3. The total cost of the order, comprising the price of the products and delivery costs, is displayed in the Shopping Basket before the Customer places the order.
  4. The Shop reserves the right to change product prices, except for orders placed before the price change.
  5. The Shop may run promotional campaigns and sales in accordance with separately specified terms and conditions.

5. Shopping in the Shop

  1. The Shop is available to customers throughout the week and at any time. Customers may place orders for products available in the Shop at any time, subject to any prohibitions or restrictions arising from mandatory legal provisions.
  2. To place an order, please:
    1. If you already have an account, log in to the Shop or use the option to place an order without registering
    2. select the product you wish to order and add it to your basket by clicking ‘Add to basket’
    3. select your delivery method or choose to collect in person
    4. complete the order form, providing your exact address and billing details
    5. select a payment method
    6. select either “Order and pay” or “Order and pay on collection” – depending on your chosen payment method
    7. if you are placing an order without registering, only the “Order and pay” option is available
    8. select the option to have the invoice sent to the address provided during:
      1. for Customers with an Account – in electronic form, sent to their email address
      2. for Customers without an Account – in paper form, sent with the order
  3. The order is deemed to have been placed upon confirmation by the Buyer
  4. Submission of an order by the Customer constitutes an offer to the Shop to enter into a contract of sale for the ordered product, which becomes binding on the Customer and the Shop upon confirmation of its acceptance by the Shop; the Shop shall inform the Customer of this within 7 working days by confirming via email that the order has been accepted for fulfilment.
  5. The Customer is obliged to provide a correct and accurate delivery address to which the ordered product is to be delivered; failure to do so shall release the Shop from any liability for the consequences of non-delivery or delayed delivery of the ordered item.
  6. If it is not possible to accept the order for fulfilment, the contract between the Customer and the Shop shall not be concluded, and any payments made in respect of that order shall be refunded to the Customer without delay.
  7. The sale price includes the cost of the products ordered, as detailed on the website or in the newsletter, and the delivery charges to the delivery address specified by the Customer.
  8. The Shop reserves the right to:
    1. restrict delivery methods and payment options for any Customer who has failed to fulfil their obligation to collect the purchased product.
    2. cancel an order in the event of non-payment in full, which shall release the Shop from its obligation to fulfil the order and entitle the Customer to a refund of the amount paid in accordance with generally applicable law.
    3. impose a limit on the maximum number of items of a specific product or product category that may be purchased in a single order, providing appropriate information alongside the product.
    4. temporarily suspend sales, disable certain functions, or suspend operations due to modernisation work, technical faults, or factors beyond the Shop’s control
    5. Every order placed with the Shop constitutes a separate contract of sale and requires acceptance of the terms and conditions. The contract is concluded for the duration and for the purpose of fulfilling the order.

6. Changes to the order

  1. The customer may make changes to their order regarding the delivery address and details until payment has been made by submitting the relevant request in the ‘Your Account’ tab. In the event of cancellation of the order after payment has been made, a refund of the amount paid corresponding to the cancellation will be issued in accordance with generally applicable legal provisions, less any costs incurred by the Shop.
  2. Changes to an order can be made on the Shop’s website under the ‘Your Account’ tab or by clicking on the link sent in the order confirmation email for purchases made without registration.
  3. The customer will receive confirmation of any changes made or of the cancellation of the order at the email address provided during the ordering process.

7. Payment methods

  1. Orders placed in the Shop can be paid for:
    1. in advance, before collection – for both registered and unregistered customers,
    2. on collection of the ordered products – for registered customers only.
  2. A customer may choose one payment method for the order; it is not possible to pay for part of the order in advance and for the remainder on collection.
  3. The available payment methods depend on whether the order is paid for in advance or on delivery, as well as on the method of delivery of the ordered products. The payment method may also depend on the type of product and the value of the order. Detailed information on the available payment methods is available in the ‘Payment Methods’ tab and is displayed during the ordering process.
  4. Unregistered customers cannot place orders for delivery outside Poland. Furthermore, unregistered customers may only pay for their order in advance.
  5. Where the order is to be delivered outside Poland, payment for the order can only be made in advance.
  6. Advance payments may be made by: bank transfer, a payment card accepted by the Shop, or one of the electronic payment systems accepted by the Shop.
  7. Cash on delivery payments may be made in cash or by payment card, depending on the delivery provider’s options.
  8. In the case of payment in advance, order fulfilment begins once the Shop has received full payment for the ordered products; in the case of payments processed by a payment service provider – once that provider has confirmed that the full payment has been successfully processed; however, if full payment is not received within 3 days of the Customer receiving confirmation that the order has been accepted for fulfilment, the Shop reserves the right to cancel the order and be released from its fulfilment.
  9. In the case of cash on delivery, order fulfilment will commence once the Customer has received confirmation that the order has been accepted by the Shop.
  10. The Customer may pay for the order in advance using a payment card or one of the electronic payment systems accepted by the Shop, in conjunction with a discount code received from the Shop, which is available only to registered Customers.
  11. Discount codes have a validity period, and the Customer may only use them during that time. A discount code cannot be combined with any other discount codes or promotions.
  12. If a Customer makes a payment by payment card without registering with the Shop, an amount of 1 (one) PLN will be charged for each transaction to verify the payment card and the accuracy of the details provided. Once the amount has been successfully debited, it will be refunded within 2 working days.
  13. With some payment methods, payment for the order can only be made immediately after the order has been placed.

8. Additional payment authorisation

  1. Additional payment authorisation by entering an authorisation code is required for credit card payments where the card does not require a CVV2/CVC2 code
  2. The authorisation code will be sent to the customer via text message and email in accordance with the details provided by them when placing the order, and will be valid for 30 minutes from the time of receipt.otrzymania.

9. Order fulfilment

  1. The realization time of order is up to seven days and takes into account the time required to prepare the parcel, which depends on the availability of all the products ordered. The Shop specifies an approximate time from the moment the order is accepted until the ordered products are handed over to the courier company.
  2. If a Customer orders products with different lead times, the order will be fulfilled within the timeframe applicable to the product with the longest lead time.
  3. Orders are processed immediately after the order has been confirmed and paid for, or after selecting the cash-on-delivery option, which is available only to registered Customers.
  4. If the Customer chooses to pay in advance, payment for the order must be made within 3 working days of placing the order, and the Shop will proceed to fulfil the order once payment has been received.
  5. The Shop is obliged to deliver products free from defects.
  6. Products are delivered via a courier service to the address specified by the Customer.
  7. To collect a prepaid order from the Shop’s premises, the Customer must provide a unique code, which is sent to the Customer in the order confirmation email sent to the email address they have provided.
  8. The Buyer may collect the goods in person from the Shop’s premises during opening hours, Monday to Friday from 9 am to 8 pm, and on Saturdays from 9 am to 3 pm.
  9. In connection with the fulfilment of an order, the Shop may send the Customer a request to complete a survey and rate the fulfilment of the order.

10. Warranty and claims under the warranty

  1. In the event of a defect in the goods, the Customer may make a claim against the defective goods under the warranty or guarantee provided for in the Civil Code, provided that a guarantee has been granted.
  2. SThe Shop is liable to the Customer for physical defects, including any non-conformity of the product sold with the contract, or legal defects (warranty). The Shop is liable under the warranty if a physical defect is discovered within two years of the date on which the product was delivered to the Customer. This does not exclude or limit the rights of Customers purchasing products as Consumers, as provided for in the applicable legal provisions, including in particular Articles 556–576 of the Civil Code.
  3. To exercise the right to make a complaint under the warranty, the Customer must deliver the product in question to the Shop together with proof of purchase and a written complaint stating the reason for the complaint and the nature of the claim; the Shop will then notify the Customer of its decision within 14 calendar days. In accordance with the Civil Code, the Customer may:
    1. demand a price reduction
    2. demand that the defect be remedied
    3. demand that the item be replaced with one free from defects
    4. in the case of a material defect – submit a notice of withdrawal from the contract and demand a refund
  4. With regard to a Customer who is not a Consumer within the meaning of the law, i.e. a Customer purchasing a product for a purpose directly related to their professional or business activities, the maximum extent of the Shop’s liability permitted by law for damages arising under the warranty for physical defects in products is limited to one year from the date of delivery of the goods to the Buyer and to the price paid for the product at the Shop. The Shop may, at its discretion, resolve such a Customer’s complaint by rectifying the defects, replacing the product with a new one, or withdrawing from the contract and refunding the Customer the price paid for the product, whilst excluding all other liability.

11. Warranty terms and conditions

  1. PProducts sold by the Shop may be covered by a warranty, subject to the terms set out in the warranty certificate. The warranty covering the product sold does not exclude, limit or suspend the Customer’s rights under the statutory warranty for defects in the goods sold. For further information regarding the warranty, please contact Customer Services.
  2. In the case of a product for which the manufacturer, distributor or other guarantor has provided a guarantee, the Customer may make a complaint regarding a defective product either to the guarantee service centre, exercising the rights arising from the guarantee provided, or to the Shop, exercising the rights to which they are entitled in relation to the seller under the warranty, in accordance with § 10 of these Terms and Conditions.

12. Cancellation of an order and withdrawal from the contract

  1. A customer may cancel an order if the products included in it have not yet been prepared for dispatch.
  2. An order may be cancelled by:
    1. contacting Customer Services
    2. cancelling the order on the Shop’s website after logging into their customer account
  3. A consumer may withdraw from the contract of sale for any product purchased from the Shop within 14 (fourteen) calendar days without giving any reason and at no cost, except for the reasons described in the following paragraph.
  4. Pursuant to Article 38 of the Act of 30 May 2014 on Consumer Rights, the Consumer is not entitled to withdraw from a contract in respect of:
  5. for the provision of services, if the trader has fully performed the service with the consumer’s express consent, and the consumer was informed before the service began that they would lose the right to withdraw from the contract once the trader had fulfilled the service:
    1. where the subject matter of the contract is an item supplied in sealed packaging which, once opened, cannot be returned for health or hygiene reasons, provided that the packaging was opened after delivery
    2. where the subject matter of the contract consists of items which, by their nature, become inseparably combined with other items after delivery.
  6. The period for withdrawing from the contract begins on the date the contract is concluded, or on the date the last item, consignment or part of an order comprising multiple items delivered separately is taken into possession.
  7. A consumer wishing to exercise their right to withdraw from the contract should send the relevant notice to the Shop by email or post. They may use the form available on the Shop’s website, or the statutory model withdrawal form set out in Annex 2 to the Act of 30 May 2014 on consumer rights. To meet the deadline for withdrawing from the contract, it is sufficient for the Consumer to send notification of their intention to exercise their right to withdraw from the contract before the withdrawal period expires.
  8. In the event of withdrawal from the contract, the Consumer is obliged to return the products to the Shop in a condition that does not go beyond what is necessary to ascertain the nature of the product, as well as its characteristics and functionality. The Shop shall refund the Consumer the amount paid, including delivery costs. The Shop hereby informs you that, where Customers exercise their right to withdraw from a distance contract, the costs of returning the product shall be borne by the Customer. Furthermore, the Shop is not obliged to reimburse the Consumer for any additional costs incurred in connection with the delivery of the products in accordance with the delivery option chosen by the Consumer. Consequently, the Shop does not accept parcels returned on a cash-on-delivery basis, nor is it liable for the costs thereof; the direct cost of returning the product as a result of withdrawal is borne by the Consumer. At the same time, the Consumer is liable for any reduction in the value of the product resulting from its use in a manner exceeding that necessary to ascertain the nature, characteristics and functionality of the product. If, due to its nature, the goods cannot be returned by standard means, the Consumer shall bear the direct costs of returning the products in accordance with the estimated cost provided by the Shop.
  9. A Consumer who has withdrawn from the contract is obliged to return the product to the Shop without delay, but no later than 14 days from the date of withdrawal.
  10. PThe right to withdraw from a distance contract does not apply to any party other than a Consumer.
  11. The Customer must return the products to the following address: Playade sp. z o.o., Brzezińska 25A, 92-103 Łódź, Poland, without delay, but no later than 14 days from the date on which the Shop was notified of the withdrawal from the sales contract. The deadline is deemed to have been met if the Customer posts the goods before the deadline expires.

13. Refunds to customers

  1. The Shop shall issue a refund without delay, but no later than within 14 days in the following cases:
    1. cancellation of an order paid for in advance before it has been fulfilled
    2. return of a product / withdrawal from the contract relating to the order
    3. return of a product / withdrawal from the contract relating to an order that was collected from the Shop
    4. a complaint being upheld and it not being possible to exchange the product, rectify the defect or reduce the price
    5. the Customer’s offer regarding the order not being accepted, if the order was paid for in advance
  2. In the event of withdrawal from the contract in accordance with § 12 of these terms and conditions, the Shop shall refund the payment to the Consumer without delay, no later than within 14 days of receiving the Consumer’s notice of withdrawal from the contract, subject to the condition precedent of the product being returned by the Customer. The Shop may withhold the refund until it has received the products.
  3. The Shop shall refund the payment using the same payment method and to the same account as used by the Customer.
  4. Should it be necessary to refund the Customer for a transaction made by payment card, the Shop shall make the refund to the bank account linked to the Buyer’s payment card.

14. Promotions

  1. Promotions may be advertised on the Shop’s website and in the newsletter for a fixed or indefinite period, or until stocks of the products covered by the promotion run out. Promotions reduce the price of a product or delivery costs by a percentage or a fixed amount once the promotion’s conditions have been met, and may take the form of:
    1. product promotions – reducing the price of a product by a fixed amount or a percentage
    2. value-based promotions – reducing the total price of the Shopping Basket once promotional products have been added to it
    3. promotional bundles – when purchasing a specified quantity of any promotional products
    4. promotional sets – when purchasing a promotional set consisting of products listed in the ‘Promotions’ tab.
    5. delivery promotions – reducing delivery costs once products covered by the promotion have been added to the basket.
  2. A promotion may be subject to the entry of a discount code when placing an order.
  3. Once an order containing a promotional bundle or set has been placed, it cannot be split.
  4. Should a Customer cancel an order for a promotional bundle or set in accordance with § 12 of these terms and conditions, the cancellation may only apply to the entire promotional bundle or set. It is not possible to cancel individual products forming part of a promotional bundle or set.
  5. Promotions in the Shop cannot be combined with other promotions or discount codes.
  6. In the event of any conflict with other provisions of these Terms and Conditions, the provisions contained in this paragraph shall apply.rafie.

15. Personal data

  1. All data, including personal data provided by Customers in the Shop at any stage of their use of the Shop, is processed by Playade sp. z o.o., Brzezińska 25A, 92-103 Łódź, Poland, which is also the data controller. Customers’ personal data is processed on the basis of a contract and for the purpose of fulfilling that contract, in accordance with the principles set out in the General Data Protection Regulation (GDPR) of the European Parliament and of the Council (EU). Detailed information regarding the Store’s data processing can be found on the Store’s website on the privacy policy page.
  2. The provision of personal data by the Customer is voluntary; however, it is necessary for making purchases and using the services provided by the Shop electronically, which require the provision of personal data. The Shop processes personal data for the purpose of providing services electronically, concluding and performing contracts with the Customer for the sale of products ordered by the Customer from the Shop, and, where the Customer has given their consent as referred to in § 16 of these Terms and Conditions, also for the purpose of providing the newsletter service.
  3. The Customer has the right to access, rectify and erase their personal data. Personal data may be rectified or erased after logging in via the ‘Your Account’ tab or by submitting a request to the Website.
  4. By providing their data, the Customer declares that the personal data provided belongs to them.

16. Newsletter – a free news bulletin

  1. The Shop publishes a newsletter – a free information bulletin containing news, marketing and sales content about the products and services offered by the Shop and its business partners.
  2. Customers may subscribe to the newsletter free of charge by ticking the ‘Newsletter’ option on the registration form or, at a later date, via the ‘Your Account’ tab.
  3. Subscription to the newsletter is voluntary, free of charge and provided for an indefinite period.
  4. Customers may unsubscribe from the newsletter at any time by deselecting the ‘Newsletter’ box in the ‘Your Account’ tab or via the Website.

17. Complaints

  1. Subject to the provisions of § 11 of these Terms and Conditions, all complaints, including those concerning the operation of the Shop or services provided electronically, may be submitted to the Shop by email or post, or via the Website, stating the customer’s personal details, address, the reason for the complaint and the customer’s request.
  2. The submission of complaints by the Customer is voluntary, and the Shop shall consider them in accordance with these Terms and Conditions and the relevant legislation within 14 days of receiving the notification.

18. Final provisions

In order to ensure the highest quality of service, and for statistical purposes, the Shop uses information stored on the Customer’s device – cookies – which are read each time the web browser connects. By using a web browser whose settings allow cookies to be stored on their device, the Customer consents to cookies being stored on that device. The Customer may at any time specify the conditions under which the Shop may access cookies via their browser settings, by changing these settings to prevent the acceptance of such files. Disabling the acceptance of cookies may cause difficulties in using the Shop. Further information on this subject can be found in the privacy policy.

The Shop does not use out-of-court methods for handling complaints and pursuing claims, including out-of-court resolution of consumer disputes, unless otherwise provided for by applicable law.

Consumers may obtain free assistance regarding their rights and in the event of disputes from the Office of Competition and Consumer Protection (uokik.gov.pl); at the Provincial Inspectorate of Trade Inspection: https://www.uokik.gov.pl/wazne_adresy.php#faq595; on the ODR online platform: http://ec.europa.eu/consumers/odr/; and at the Consumers’ Federation and the Association of Polish Consumers.

Any disputes shall be settled by the court with jurisdiction over the Shop’s registered office.

Individual settings on the end-user’s device may cause differences between the product’s appearance on the Customer’s computer and the actual appearance of the product in terms of colour, shape, dimensions, etc. A Customer who is a Consumer is entitled to withdraw from the contract in accordance with the provisions of § 12 of these Terms and Conditions.

These Terms and Conditions are governed by the laws of the Republic of Poland.
